What to do after a car accident that isn’t your fault.

If you were injured in a car accident that was not your fault- don’t panic. Here are four things to do immediately after a wreck.

  1. SEEK MEDICAL TREATMENT

This is easy advice when there are obvious signs of injuries, like broken bones or serious lacerations. However, many people are injured internally in car accidents but do not realize it. This is because pain symptoms for some types of trauma, like whiplash, can be delayed from several hours to several days. This is why it is always important to seek out treatment as soon as possible, whether via ambulance, going to the ER, or going to an urgent care facility. Request and keep all of your medical records and medical billing information.

  1. GATHER EVIDENCE

If possible, you will want to gather as much information at the scene as possible. Gathering evidence at this stage is critical. The more information that you have which establishes fault by the other driver, the better. You will want to take photographs of both vehicles, particularly the damaged portions. If possible, take photographs of the entire wreck scene, so that it’s possible to see how the vehicles came to rest after the wreck. Gather witness names and addresses, and find out what they say.

  1. DO NOT HELP THE OTHER PARTY

The at-fault driver’s insurance company will want to get a recorded statement from you. Do NOT give it to them. The adjuster is trained to get information from you similarly to a lawyer on cross examination. The adjuster will use what you say against you for the purposes of undervaluing your claim.

The at-fault driver’s insurance company will also request that you provide authorization to view your medical records and medical history. Do NOT let them do this. This information is used to link previous injuries or conditions to your present injuries for purposes of undervaluing your claim.

  1. CONTACT YOUR INSURANCE COMPANY

If you’ve been seriously injured in a car accident that was not your fault, you will want to speak with YOUR car insurance company. This is important because often, in order to collect underinsured or uninsured motorist coverage from your own policy requires notifying them in a timely fashion.
