In addition to possibly receiving financial compensation, filing an abuse or neglect lawsuit against a nursing facility can result in there being criminal charges. This can also occur in the case of wrongful death lawsuits. Since so many cases of elder abuse and neglect go unreported, this may be the only way to see those responsible for their actions pay for their crimes. The Atlanta Journal and Constitution report on the arrests of three women in the case of the death of a World War II veteran.
Footage of 89-year-old James Dempsey was released last November and showed him to be in respiratory distress and calling out for help. The lawsuit that Dempsey’s family filed against the nursing home where Dempsey was staying prompted law enforcement to investigate.
63-year-old former licensed nurse Loyce Pickquet Agyeman was arrested on charges of felony murder and neglect to an elder person. 62-year-old Mabel Turman was charged with neglect to an elder person. 61-year-old Wanda Nuckles was charged with depriving an elder person of essential services.
All three women face charges of concealing a death. The charges come four years after Dempsey’s death at Northeast Atlanta Rehabilitation Center. In the released video, Dempsey becomes unresponsive after calling out for help several times. He was later found deceased in his bed.
